By accessing or using Time for Pictures ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Time for Pictures (operated by Matthew Rolt, Hubelbrunnenstr. 10, 67688 Rodenbach, Germany; email: [email protected]).
Time for Pictures is a platform designed to connect photographers, models, and photography studios for the purpose of organising TFP (Time for Print / Trade for Print) collaborations, studio bookings, and photography events. The Platform provides tools for profile creation, event coordination, studio discovery, direct messaging, booking management, and optional identity verification.
You must be at least 18 years of age and have full legal capacity to enter into a binding contract in your jurisdiction to use the Platform. By creating an account, you confirm that you are 18 or older and that all information you provide is accurate and complete. We reserve the right to terminate accounts where we have reason to believe this requirement has not been met.
To access most features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account at [email protected].
We offer optional identity verification through Stripe Identity. Verified accounts receive a visible badge on their profile. Verification is encouraged for safety but does not constitute an endorsement by Time for Pictures of any user's conduct or character.
You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You must not:
You retain ownership of any content you upload to the Platform, including photographs, profile information, and messages. By uploading content, you grant Time for Pictures a non-exclusive, royalty-free, worldwide licence to store, display, and distribute your content solely for the purpose of operating the Platform. This licence terminates when you delete the content or your account.
You are solely responsible for ensuring that any content you upload does not violate the rights of third parties. Where photographs feature other individuals, you must have obtained all necessary consents (including under the UK's right of publicity and Germany's Kunsturhebergesetz § 22 KUG) before uploading.
Time for Pictures facilitates connections between users but is not a party to any TFP arrangement agreed between them. Individual TFP agreements are made directly between the parties involved. Time for Pictures accepts no liability for the performance, content, or consequences of such arrangements. Users are solely responsible for their own safety when meeting other users in person.
Studio bookings made through the Platform are subject to the individual studio's cancellation and refund policies. Time for Pictures acts as a facilitator of bookings and is not a party to the underlying agreement between users and studios.
Payment processing is handled by Stripe, Inc. By making a payment through the Platform, you agree to Stripe's terms of service. Time for Pictures does not store payment card details.
Where we provide paid digital services (such as optional identity verification), the following applies:
UK users (Consumer Rights Act 2015 / Consumer Contracts Regulations 2013): You have a 14-day right to cancel a contract for digital services. However, by expressly requesting that we begin providing the digital service immediately and acknowledging that you will lose your right to cancel once the service has been fully performed, you agree that the right to cancel is waived upon commencement of the service.
German / EU users (§ 356 Abs. 5 BGB): The right of withdrawal for digital content not supplied on a physical medium expires upon commencement of performance, provided you have given your express consent and acknowledged the loss of the right of withdrawal.
We reserve the right to suspend or permanently ban any account that violates these Terms, without prior notice in serious cases. We may also remove any content that we determine violates these Terms or is otherwise harmful to the Platform or its users. If your account is suspended or banned, you may contact us at [email protected] to appeal the decision.
The Platform is provided on an "as is" and "as available" basis. To the extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, or that user-provided information is accurate beyond the identity verification process.
Nothing in these Terms affects any statutory rights you may have as a consumer under UK or German law that cannot be excluded or limited by contract.
We do not limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Subject to the above, and to the extent permitted by applicable law, Time for Pictures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including damages arising from meetings arranged through the Platform. Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount paid by you to us in the 12 months preceding the claim.
We may update these Terms from time to time. We will notify registered users of material changes by email or through a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms. If you do not accept the changes, you may close your account before they take effect.
For UK users: These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. Nothing in this clause affects your rights as a consumer under UK law to bring proceedings in the courts of the country where you are resident.
For German / EU users: These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Kaiserslautern, Germany, to the extent permitted by law. Mandatory consumer protection provisions of the EU Member State in which you are habitually resident continue to apply.
